Pursuant to section 138 of the Credit Contracts and Consumer Finance Act 2003 , Her Excellency the Governor-General, acting on the advice and with the consent of the The Government introduced a Bill into Parliament on 4 April amending the Credit Contracts and Consumer Finance Act. The Bill responds to issues identified by MBIE following its review of the consumer credit sector in 2018, and introduces significant changes that will take effect on 1 March 2020.

Also, the Regulatory Systems (Economic Development) Amendment Act 2019 will make some minor amendments to the Credit Contracts and Consumer Finance Act 2003. These changes will come into force on 13 January 2020. Importantly, the changes disapply some rules to credit contracts which are not consumer credit contracts which will be welcomed. Contracts and Consumer Finance Act contained in section 69 of the Credit Contracts Legislation Amendment Act (the section 69 Regulations ), the proposed draft of the Credit Contracts and Consumer Finance Amendment Regulations 2020 (the Draft Credit Contracts and Consumer Finance Amendment Regulations 2020 r 4 (b) take the borrower ’s likely living expenses to be the greater of the lend-er ’s initial estimate of living expenses and a reasonable cost of those expenses, unless there are reasonable grounds to do otherwise.

Bill History. This bill amends the Credit Contracts Act by strengthening requirements to lend responsibly, especially in relation to how affordability and suitability tests should be conducted, limiting the accumulation of interest and fees on high-cost loans, and providing new remedies and penalties for non-compliance.
